Recommended Prerequisites

The student must have basic knowledge of criminal law (general theory of the crime and legal consequences of the crime) and criminal procedural law, taught in the first cycle of studies.

Teaching Methods

Theoretical exposition of the themes and resolution of practical hypotheses. Analysis of relevant jurisprudence.

Learning Outcomes

The student must understand and problematize, in its theoretical and practical (jurisprudential) dimensions, the knowledge related to the program of the course, namely, the regime regarding the means of proof and the means of obtaining evidence in criminal proceedings.

1. Means of proof and means of obtaining evidence - distinction.

2. Principles related to proof.

3. Rules for producing evidence and prohibitions of evidence.

4. The evidence and the means of obtaining evidence provided for in the Code of Criminal Procedure.

5. The DNA profile as a means of proof in criminal proceedings (Law No. 5/2008, of 12 February).

6. The means of proof and means of obtaining evidence provided for in the Cybercrime Law (Law No. 109/2009, of 15 September).

7. Hidden methods of investigation.
