Teaching Methods

Seminar-like classes: under the instructor's moderation, the core topics of a properly designed methodology of Law are discussed with the purpose of stressing in that respect the centrality of analogy.

Learning Outcomes

Reflect on the normatively constitutive judicial adjudication, not under a sociological and /or functional perspective, but rather under one focused in the meaning intended and the task involved. Refusal of capitulating to the theory of the normative force of the fact or to an "academic methodology".

Syllabus

The detailing of the noematic (i.e. the case sub judice, the foundation system and the dialectics involved) and noetic (the type of reasoning to be adopted for the said dialectics) dimensions of the method-nomo-logical activity.

The case sub judice - the "inquiring" underlying it, the referent which predicates it and the universe substiantiated anew.

The foundation system - the issues, foundations and criteria constitutive of it and the dialectics into which all these levels are intertwined.

Method-nomo-logical activity and analogy - judgment and analogy; judicial adjudication as mediated by the legal system, and analogy; judicial adjudication through trans-systematic development and analogy
