Learning Outcomes

he curricular unit aims to accomplish a stimulate reflection on the evolution of  civil procedure, especially as it has occurred  in recent years. Ideally this would take into account the enhanced powers of  jugdes, the need to diversify the procedure of legal protection and the articulation of non-judicial means with civil justice.

1. The new model of the declarative process.

1.1 The judge as the case manager.

2. The search for differentiated guardianship.

2.1. Simplification of procedure before the fair trial guarantees

3. The end of the principle of legality of procedural discipline

3.1. Flexibility of the procedure by judicial initiative.

3.2. The contractualisation of the process. The French experience (the figure of the "Protocole").

4. The articulation between extrajudicial means and public justice: the case of pre-judicial and intra-judicial mediation.
