Trademarks and Patents in the European Union

Recommended Prerequisites

The student must have the 2nd cycle studies and have  knowledges in english and french.

There will be Lectures. The evaluation will be conducted throught an individual paper analyzed and discussed with the other students.

Learning Outcomes

Providing students with knowledge about new issues on Intellectual Property Rights, especially the Advanced Legal Framework on European Trade Marks Rights and Patent Rights.

Syllabus

1. European Union Trademarks. The Regulation (EC) Nº 207/2009 and the Regulation (EU) Nº 2015/2424.

2. The acquisition of trademarkrights.

3. Signs of which an EU trade mark may consist.

4. Transfering and licensing trade mark rights, and other acts in the Register relating to trade mark rights (e.g., levy of execution and insolvency).

5. The extinction of trade mark rights: invalidity; revocation and loss of rights.

6. The european patents rights legal framework. the sources of patent law. The european patent with and without unitary effect. The Unified Patent Court (Regulations 1257/2012 and 1260/2012).

7. Concession of european patents by the European Patent Office.

8. Transfer and constitution of rights: assignment; licensing and other acts.

9. Extinction of patent rights.
