Exposition, exploration and discussion of themes and specific examples of juridical materials starting from accompanied readings in class

Learning Outcomes

The aims of this course focuse on the reflection on the differences and similarities of cultural original matrices and in the parallel developments of the contemporary Portuguese and Chinese legal systems, looking for a historical investigation of the nucleares issues of the perspectivation of the creation of law, of legal thinking and of the practical realization of law.

Students shall understand law matrices of Portuguese Law and Chinese Law and have a comparative knowledge of the sources of Law, the doctrinal trends and the transformations undergone in both legal systems.

1. The culturally coined configurations of the portuguese and chinese juridical systems experiences: from oriental and ocidental antiquity to the conteporary globalization

2. Sources of portuguese and chinese law - from the diacronical relevance of common law to the accentuation and meaning(s) of the legal determination

3. Law in traditional China and in modern China

4.The influence of portuguese law in Macau - the romanic-germanic matrix and the legislative construction:

4.1. the organization of the special administrative region of Macau

4.2. the legal system of Macau

5. Construction of law, legal thinking and practical realization of law: convergence and differetiation poles

6. Contemporary comparative perspectivation of some juridical-dogmatic dimensions:

6.1. constitutional law

6.2. civil law and civil procedure

6.3. criminal law and criminal procedure

6.4. administrative law and administrative procedure

7. Comparative reflexive synthesis.
