Learning Outcomes

The aim is stimulate reflection on the evolution of civil procedure over the last few years with a special focus on the enhanced powers of  jugdes, the need to diversify the procedure of legal protection and the articulation of non-judicial means with civil justice.

1. The new model of declaratory judgement action

1.1 The judge as manager in the proceedings

2. The search for a special civil procedure

2.1. Procedural simplification in the face of due process of law

3. The end of the principle of legality of procedural rules

3.1. Inquisitorial procedure flexibilization

3.2. Procedure agreements. The French experience (the "Protocole" figure)

4. The connection between alternative dispute resolution (ADR) and civil public justice:  pre-trial mediation and intraprocedural mediation.
