Teaching Methods

The curricular unit requires the combination of teaching exhibition strategies concerning the grounds of legal issues and processes of discussion (sometimes with the participation of professionals) around specific cases, processes of reasoning decisions and procedural monitoring / execution of them.

Learning Outcomes

Objectives: The curricular unit of Family and Children Law aims to provide legal information in the field of family and children, in order to prepare graduates in social work to understand the legal framework that regulates family relations, with particular emphasis in the field of filiation, parental responsibilities, divorce, adoption, special guardianship and the system of promotion and protection of children and young people in danger. These skills are considered essential for an efficient and effective performance in the area of civil justice and children protection and promotion. Skills: it provides knowledge and ability to analyze the legal framework in the area of family and children Law, argumentative skills necessary to support statements and follow-up plans that will support the lower court decision making, as well as operational skills in the field of the access to rights and guarantees.

FAMILY LAW

Family legal concept; genreal and constitutional principles of Family Law; family relationships ; marriage;  de facto  unions; divorce; legal parenthood.

CHILDREN LAW

Parental responsbilities: concept, grounds, purposes, content, exercise and child best interest.

Adoption: concept and spirit of the institute; types of adoption; constitution;  effects.

Adoption and special guardianship.

System of promotion and protection of children and youth in danger: guiding principles of intervention, competent authorities; judicial process; promotion and protection measures; purposes of promotion and protection measures.

Educational guardianship system: educational guardianship intervention with children and young people; institutional measures and non-institutional measures.
