Teaching Methods

The teaching combines oral presentation by the teacher.

It is developed around various methodological approaches:

a) Exposure of the major theoretical concepts combined with the analysis of the relevant legislation;

b) Questioning the students in order to promote the critical analysis;

c) Presentation and critical analysis of competition issues decided by the competition authorities and by the courts;

d) Resolution of practical exercises in order to apply the theoretical concepts.

Learning Outcomes

The teaching of the Competition Law shall respond to training needs from the future corporate leaders.

It is intended that students achieve the following skills:

a) Knowledge of the specific competition law language;

b) In the business context, identification of the competition issues;

c) Capacity to express one’s own opinion and critical abilities;

d) Capacity to team-work and ability to communicate with legal experts on competition law;

e) Capacity to implement the legal knowledge on the business action;

f) Capacity to deal with new situations;

g) Capacity to research on competition law.

The students shall achieve the following subject-area related skills:

a) Identify the most important anticompetitive conducts;

b) Understand the legal consequences;

c) Recognize the mechanisms to react against anticompetitive practices;

d) Select the competent authority to address a complaint and competent to punish the anticompetitive practices;

e) Select the permitted and the forbidden state aid.

Syllabus

The Competition Law studies both national and EU level regulation. Special attention is given to the Treaty on the Functioning of the European Union, the regulations, the Commission Guidelines, and the Law n.º 19/2012, 8 may.

The first part studies the definition of the Competition Law, the application of the EU competition law and the definition of the relevant market.

The second part of the course unit deals with the anticompetitive practices, the legal sanctions and the mechanisms to react. This part of the course unit studies: a) competitive restrictive practices, abuse of dominant position; b) mergers’ control and the duty to notify the merger.

The third part deals with the state aid and the impacts on competition.

The students will be able to know the best practices on competition that they can implement on the business decisions.
